All bookings are subject to availability and confirmation by TahitiActivity.com
A binding contract is formed when you receive written confirmation from us after payment of the required deposit or full payment
You must provide accurate information for all participants, including full names, ages, contact details, and any relevant medical or physical conditions
Special requests (dietary requirements, accessibility needs, etc.) should be communicated at the time of booking but cannot be guaranteed
2.2 Booking Confirmation
You will receive a booking confirmation via email containing your reservation details, itinerary, payment information, and booking reference number
Please review your confirmation carefully and notify us immediately of any errors or discrepancies
It is your responsibility to ensure that the names on the booking match the names on identification documents that will be used during travel
2.3 Minimum Age Requirements
Certain activities may have minimum age requirements for safety reasons. These requirements will be clearly stated in the activity description. Parents or legal guardians must accompany minors on all activities unless otherwise specified.
3. Pricing and Payment
3.1 Prices
All prices are quoted in US Dollars (USD) unless otherwise stated
Prices are subject to change without notice until booking is confirmed
The price applicable to your booking is the price quoted and confirmed at the time of reservation
Prices include the services and inclusions specified in your booking confirmation
Additional costs such as transportation to meeting points, meals not specified, personal expenses, gratuities, and optional extras are not included unless explicitly stated

3.3 Payment Methods
We accept major credit cards (Visa, MasterCard, American Express), PayPal, and bank transfers. Payment must be made in the currency specified in your booking confirmation.
3.4 Taxes and Fees
All applicable taxes, service fees, and booking fees are included in the quoted price unless otherwise stated. Additional government-imposed taxes or fees may apply and will be clearly indicated.
4. Cancellations and Refunds
4.1 Cancellations by Customer
If you need to cancel your booking, you must notify us in writing via email. Cancellation fees apply as follows:

4.2 Cancellations by TahitiActivity.com
We reserve the right to cancel any activity due to:
Insufficient participant numbers
Weather conditions that make the activity unsafe
Equipment failure or unavailability
Force majeure events (natural disasters, pandemics, political instability, etc.)
Any other circumstances beyond our reasonable control
If we cancel your activity, you will receive:
A full refund of all payments made, OR
The option to reschedule to an alternative date, OR
Credit towards another activity of equal or greater value
We are not liable for any additional costs you may have incurred such as flights, accommodation, or other travel arrangements.
4.3 Changes to Bookings
Changes to bookings are subject to availability and may incur an administration fee of $25 per change
Changes requested within 14 days of the activity date may not be possible
Requests to change dates, times, or participant numbers must be made in writing
5. Weather and Operating Conditions
5.1 Weather-Dependent Activities
Many of our activities are weather-dependent and subject to safe operating conditions:
Activities may be modified, postponed, or cancelled due to adverse weather conditions
Our guides and operators have sole discretion to determine whether conditions are safe to proceed
If weather causes cancellation, you will be offered a reschedule or full refund
We are not responsible for weather conditions and cannot guarantee specific weather during your activity
5.2 Itinerary Changes
Routes, schedules, and itineraries are subject to change without notice due to weather, safety concerns, or operational requirements
We reserve the right to substitute activities or services of equal or greater value if necessary
You acknowledge that flexibility is required when participating in outdoor activities
6. Health, Safety, and Participation Requirements
6.1 Medical and Physical Fitness
You must disclose any medical conditions, physical limitations, disabilities, allergies, or pregnancy that may affect your ability to participate safely
Some activities require a minimum level of physical fitness, which will be specified in the activity description
We reserve the right to refuse participation if we believe your health or fitness level poses a risk to yourself or others
You acknowledge that participation in activities involves inherent physical exertion and risk
6.2 Assumption of Risk
By participating in our activities, you acknowledge and accept that:
All outdoor and adventure activities involve inherent risks including but not limited to: injury, illness, disability, death, property damage, or loss
Risks may include: exposure to elements, uneven terrain, water hazards, wildlife encounters, equipment failure, actions of other participants, and negligence of guides or operators
You voluntarily assume all risks associated with participation
You have been given the opportunity to ask questions and have received satisfactory answers regarding the activity and associated risks
6.3 Safety Requirements
You must follow all safety instructions provided by guides and operators
You must use all safety equipment as instructed
You must not participate under the influence of alcohol or drugs
Failure to comply with safety instructions may result in immediate removal from the activity without refund
6.4 Swimming and Water Activities
For activities involving water:
You must disclose your swimming ability at the time of booking
Life jackets will be provided for non-swimmers or weak swimmers where applicable
Participants engage in water activities at their own risk
7. Conduct and Behavior
7.1 Expected Behavior
All participants must:
Behave in a respectful and courteous manner towards guides, staff, other participants, and local communities
Respect local customs, culture, and environmental regulations
Follow instructions from guides and operators
Not engage in illegal activities or behavior that endangers themselves or others
7.2 Removal from Activities
We reserve the right to remove any participant from an activity without refund if:
Their behavior is deemed dangerous, disruptive, or offensive
They fail to follow safety instructions
They are under the influence of alcohol or drugs
They pose a risk to themselves, staff, or other participants
8. Photography and Media
Our guides and staff may take photographs or videos during activities for promotional purposes
By participating, you consent to the use of photographs or videos in which you appear for marketing, promotional, and social media purposes without compensation
If you do not wish to be photographed or filmed, please inform your guide at the start of the activity
You may take personal photographs during activities unless restricted for safety or cultural reasons
9. Liability and Indemnification
9.1 Limitation of Liability
To the fullest extent permitted by law:

We are not liable for indirect, consequential, or punitive damages
9.2 Indemnification
You agree to indemnify, defend, and hold harmless TahitiActivity.com, its owners, employees, agents, and contractors from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:
Your participation in any activity
Your violation of these Terms
Your violation of any rights of third parties
Your negligent or intentional misconduct
9.3 Travel Insurance
We strongly recommend that all participants obtain comprehensive travel insurance covering medical expenses, trip cancellation, personal liability, and adventure activities
Travel insurance is your responsibility and we are not liable for any losses that would have been covered by adequate insurance
Some activities may require proof of travel insurance before participation
10. Personal Property
You are responsible for your personal belongings at all times
TahitiActivity.com is not responsible for lost, stolen, or damaged personal property
We recommend leaving valuables in a secure location and bringing only necessary items on activities
Waterproof protection for electronic devices and valuables is recommended for water-based activities
11. Third-Party Services
Some activities may be operated by third-party providers under agreement with TahitiActivity.com
Third-party providers may have their own terms and conditions which will apply in addition to these Terms
We are not responsible for the acts, errors, omissions, or negligence of third-party providers
Complaints regarding third-party services should be directed to us for resolution

Participants must respect natural environments and not litter, damage coral reefs, disturb wildlife, or remove natural materials
Single-use plastics should be minimized; bring reusable water bottles where possible

Formal complaints must be submitted in writing to info@tahitiactivity.com within 14 days of the activity date
We will acknowledge your complaint within 48 hours and provide a full response within 14 business days
14.2 Dispute Resolution
We will make reasonable efforts to resolve disputes amicably through direct communication
If a dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing legal action
Any legal proceedings shall be governed by the laws of French Polynesia
15. Force Majeure
We shall not be liable for failure to perform our obligations due to events beyond our reasonable control including but not limited to:
Natural disasters (hurricanes, earthquakes, tsunamis, volcanic eruptions)
Pandemics or public health emergencies
